Despite the fact that vehicle related accidents can all cause injuries and death, there are complex differences between a car and a truck accident. For starters, trucks are regulated by federal laws. So a truck driver must go through special training in order to obtain a license to drive a truck. Performing maneuvers on the road with a truck is much more complicated than with a car, which is smaller, weighs less, and is easier to handle.  A truck is used mainly for loading and unloading machinery, or heavy materials across the nation. The truck driver will be required to know how to load and unload their truck as well.

Special training isn’t really required when driving a car. You simply need to know how to drive and pass a driving test. If a car were responsible for causing an accident, the only person who would be held accountable would be the driver themselves. Truckers require a special license. If they don’t have the appropriate training and they happen to be involved in an accident, they are negligible and can be sued for violating the regulations. Most truck drivers work for a trucking company. So if that company has failed to give their drivers the proper training, or if they hired someone without verifying their driving qualifications, they are just as liable as the truck driver involved in the accident.

The slightest violation from a truck driver can prove negligence in a court of law, which would most likely strengthen the case of the plaintiff suing the trucker. Since these rule violations don’t apply to other vehicles, if two cars were to be in an accident, it can become very difficult to prove which driver was at fault and liable for the other party’s medical costs and other expenses, especially if you live in a no-fault State.

Truckers are required to have more insurance coverage than the average car driver. This is mainly because a truck can cause a great deal more damage during an accident. Aside from severe injuries and death, the truck could potentially total a car, which would force the trucker’s insurance to pay the market value price of the vehicle it destroyed to the owner.

The more insurance coverage that the trucker and/or trucking company has, the better the chances your lawyer has to win a case with bigger financial compensation. So if you’ve been hit by a truck, consult a truck accident lawyer immediately for legal guidance.
